How we think about your data

Popped Up! helps you find pop-ups around NYC. To do that, we collect a small amount of information, and we want to be straight with you about what we collect and why.

Here's the short version:

  • We don't sell or rent your personal data. We make money from our product, not from your information.
  • Location is optional. We only use your location if you turn it on, and you can turn it off any time.
  • We don't show you ads based on your personal data.
  • We don't ask for your full name, and we don't touch your phone's contacts.

This policy applies to the Popped Up! mobile app and any related services (the "Service"), operated by Popped Up, Inc., a Delaware corporation ("Popped Up!", "we", "us", or "our").

Information we collect

Information you give us

When you create an account, we collect:

  • Your email address. You sign in with Apple or Google, and we receive your email from that provider. If you sign in with Apple, you may choose to hide your email, in which case Apple gives us a private relay address instead.
  • Your birthday.We require this to confirm your age and to show you age-appropriate pop-ups (see "Age requirements" below). We use your birthday for age-gating; we never display your birth year to anyone.
  • Your interests. The event categories you select so we can surface relevant pop-ups. Some categories are age-restricted (see below).

You can also choose to provide:

  • A profile picture.
  • Pronouns (optional).
  • Any other information you add to your profile.

Content you create

When you message other users through our chat, or post photos to a pop-up's gallery, we collect and store that content so we can operate those features. Depending on the feature, this content may be visible to other users — so don't share anything you wouldn't want others to see.

Following and logging pop-ups.You can follow other users and be followed by them, and you can log pop-ups you've been to or want to check out. We store these follow connections and logs so we can run those features. You can unfollow anyone, or remove a pop-up you've logged, at any time.

You control your content.You can delete your own messages and the photos you've posted at any time, and you can delete your entire account from inside the app. When you delete content, we remove it from our active systems.

Reporting, blocking, and hiding.You can report another user's message or photo if it breaks our rules, block a user so you no longer interact with them, or hide a specific pop-up or photo so it stops showing up in your feed. When you report something, we collect your report — the content you flagged, the reason you chose, and any detail you add — and may review or remove that content. Blocking and hiding take effect for you right away.

Push notifications

With your permission, we send push notifications — for example, about new or nearby pop-ups. To deliver them, we collect a device token from Apple or Google. You can turn notifications off any time in your device settings.

Location

You can choose to share your device's location so we can show you pop-ups near you. We only access your location if you grant permission, and you can turn it off any time in your device settings. If you don't share it, you can still browse using the neighborhood filter.

The neighborhood selector is a filter you apply to listings — a manual choice, not your actual location — and we don't store it as part of your profile.

Information we collect automatically

When you use the app, we automatically collect standard technical information, including:

  • Device and log data — your IP address, device type, operating system, app version, language settings, and similar details.
  • Usage data — how you interact with the app, such as which screens you view, which pop-ups you tap, searches you run, and the date and time of your activity.
  • Diagnostic data — crash reports and performance information that help us fix bugs and keep the app stable.

We collect this through our infrastructure and analytics providers (described under "Who we share data with").

What we don't collect

  • We don't collect your full name.
  • We don't access your phone's contacts.
  • We don't sell your data to anyone.

How others see your information

Your profile is public. Other users of Popped Up! can see your profile, which may include your profile picture, your pronouns (if you add them), and your interests. Other users cannot see your email address or your birthday.

Other users can follow you, and you can follow them. Your followers and the people you follow may be shown on your profile, along with pop-ups you've logged. You can unfollow, block, or report another user at any time; blocking someone also removes the follow connection between you.

Messages you send and photos you post to a pop-up's gallery are visible to the other users who can see those features. Anything you choose to make public is visible to other users, so only add what you're comfortable sharing.

How we use your information

We use the information above to:

  • Create and run your account, and sign you in.
  • Show you pop-ups, filtered by your interests, neighborhood selection, location (if shared), and age.
  • Hide age-restricted content from users who aren't old enough to see it.
  • Send you notifications and account, security, and service-related messages.
  • Fix bugs, monitor performance, and improve the app.
  • Keep the Service safe — detecting and preventing fraud, abuse, and unauthorized access.
  • Operate safety features like reporting, blocking, and hiding, and review reported content.
  • Run social features like following, and let you log and keep track of pop-ups.
  • Comply with the law and enforce our terms.

We may use de-identified or aggregated data (information that can no longer be tied to you) to understand how the app is used and to improve it.

Who we share data with

We don't sell your personal data. We share it only in these situations:

  • Service providers. Companies that run parts of our Service on our behalf — for example, sign-in and authentication, database hosting, analytics, crash reporting, and push notification delivery. They can only use your data to provide their service to us, and some may process limited data under their own privacy practices.
  • Legal and safety reasons.If we're required to by law, or to respond to lawful requests from authorities, protect our rights or yours, or investigate fraud or abuse.
  • Business transfers.If we're involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that deal. We'll let you know if your data becomes subject to a different privacy policy.

Age requirements

Popped Up! is for users 18 and older. We don't knowingly collect personal information from anyone under 18. If we learn we've collected data from someone under 18, we'll delete it. If you believe a minor has given us their information, email us at hello@popped-up.com.

Age-restricted content.Some event categories — including those involving alcohol or cannabis — are limited to users who are 21 or older. We use your birthday to determine which categories and pop-ups you can see and select. If you're under 21, this content is hidden from you and you can't select those interests.

Your choices and rights

You can:

  • Access the personal information we hold about you.
  • Correct information that's wrong or out of date.
  • Delete your account directly in the app, along with your profile, messages, and photos — or delete individual messages and photos without removing your whole account.
  • Withdraw consent where we relied on it (this doesn't affect processing we already did).
  • Control notifications and location any time through your device settings.

Residents of certain states (including California, Colorado, Connecticut, Virginia, Utah, and others) have additional rights under state privacy laws, including the right to opt out of the "sale" or "sharing" of personal information. To be clear: we don't sell your personal data, and we don't share it for cross-context behavioral advertising. You can still contact us at the email above to exercise any rights you have under your state's law, and we won't discriminate against you for doing so.

How long we keep your data

We keep your personal information for as long as your account is active, and for a reasonable period afterward to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our terms. When you delete a message or photo, we remove it from our active systems. When you delete your account, we delete or de-identify your information — including your profile, messages, and photos — from our active systems, though copies may remain on backups for a limited time. We may keep a limited record of reports and safety actions (such as blocks) for as long as we need it to keep the Service safe and enforce our rules, even after the related content or account is gone.

How we protect your data

We use reasonable technical and organizational measures to protect your information. That said, no method of transmission or storage over the internet is ever completely secure, so we can't guarantee absolute security.

Third-party links and services

The app may link to or integrate with third-party services (for example, the sign-in providers above, or a pop-up's own website). This policy doesn't cover those services — review their privacy policies separately.

International users

We're based in the United States and store your information here. If you use Popped Up! from outside the U.S., you understand your information will be transferred to and processed in the U.S., which may have different data protection laws than your home country.

Changes to this policy

We may update this policy from time to time. If we make material changes, we'll let you know through the app or by another reasonable method before they take effect, and we'll update the "Last updated" date above.
