Terms of service

Welcome to Popped Up! These Terms are the agreement between you and Popped Up, Inc., a Delaware corporation ("Popped Up!", "we", "us", or "our"). By creating an account or using the app, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the app.

Who can use Popped Up!

You must be 18 or older to use Popped Up!. Some event categories — including those involving alcohol or cannabis — are limited to users who are 21 or older, and we use your birthday to gate that content. You agree to give accurate information, including your real date of birth.

Your account

You're responsible for your account and for what happens under it, including keeping your login secure. One account per person. We may suspend or close accounts that violate these Terms.

Acceptable use and community standards

Popped Up! has zero tolerance for objectionable content and abusive behavior. When you post messages, photos to a pop-up's gallery, follow other users, log pop-ups, or add any other content, you agree not to post or do any of the following:

• Harassment, bullying, threats, or hate speech toward anyone.
• Sexually explicit, violent, or graphic content.
• Content that is illegal, promotes illegal activity, or endangers anyone — including content that sexualizes or endangers minors.
• Impersonation, spam, scams, or deceptive content.
• Sharing someone else's private information without permission.

We provide tools to report content, block other users, unfollow anyone, and hide specific pop-ups or photos from your feed — use them. When you report or hide something, it stops showing up for you; reports also come to us. We may review, remove, or restrict any content, and we may suspend or permanently ban any user, at our discretion and without notice, for violating these standards. We are not obligated to host any content.

Content you post

You keep ownership of the content you create. By posting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content as needed to operate the app and its features. You're responsible for the content you post and confirm you have the right to post it. You can delete your messages and photos at any time, and you can delete your whole account from within the app. Deleting content removes it from the app, though we may keep limited records — such as reports and safety actions — as described in our Privacy Policy.

Things you may not do

Don't misuse the app — including by reverse-engineering it, scraping or harvesting data, interfering with its operation or security, accessing it through unauthorized means, or using it to break the law or these Terms.

Pop-ups are run by others

Popped Up! is a discovery platform. The pop-ups and events listed are organized and run by brands, hosts, and other third parties — not by us. We don't control them and aren't responsible for the events themselves, what happens at them, or anything you buy or agree to with a host. Listings are provided for discovery only.

Termination

You can delete your account — along with your individual messages and photos — at any time from within the app. We may suspend or terminate your access at any time if you violate these Terms or to protect the app or its users. Some sections of these Terms survive termination, including the content license you granted, disclaimers, and limitation of liability.

Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't guarantee the app will be uninterrupted, error-free, secure, or that listings are accurate or complete.

Limitation of liability

To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of the app, your interactions with other users, or your attendance at any pop-up.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll let you know through the app or another reasonable method, and update the date above. Continuing to use the app after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
